Advice is also available on the scope and applicability of the Directive, considering factors like company size, structure, and worker types, alongside thorough risk assessments to identify key legal risks associated with non-compliance under Maltese regulations.
Furthermore, comprehensive support is offered for compliance strategy and implementation. This involves conducting gap analyses and compliance audits of existing pay structures, HR policies, recruitment practices, and job evaluation systems against the Directive's requirements and Maltese law.
Based on these findings, tailored strategic roadmaps are developed, outlining compliance plans and timelines, particularly aiming for readiness by deadlines such as June 2026.
Policy drafting and Review
Assistance extends to policy drafting and review, covering employment contracts, HR handbooks, recruitment policies (including implementing bans on salary history questions and advising on salary ranges), internal communication protocols, and data privacy policies, ensuring they align with pay transparency principles and GDPR interplay.
Pay Reporting
Guidance specific to pay reporting for employers with over 100 employees is provided, detailing metrics, calculation methods, formats, and deadlines under mandatory pay gap reporting legislation in Malta. This includes the legal review of draft pay gap reports to ensure accuracy and legal compliance. Finally, support is available for managing employee rights and requests, encompassing process design for handling employee requests for pay information efficiently, compliantly, and within stipulated timeframes, respecting transparency and GDPR. This includes assistance in formulating legally appropriate responses to complex or sensitive employee requests.
Union and Worker Representative Engagement Support
Specific support is also available for processes involving broader employee representation. This includes assistance during Joint Pay Assessments, which typically involve collaboration or negotiation with unions or worker representatives, ensuring that these assessments are conducted in line with legal requirements and strategic objectives.
